For you homeowners who live in a community with a Home Owners Association or a Condo Association or Cooperative Association, it is important to be aware of the new laws in affect as of July 1 in the State of Florida.

If you are behind on your maintenance fee, legally the Home Owners Association, Condo Association and Cooperative Association has the right to obtain your monthly rent payment from your tenant as payment for your delinquent maintenance fee and or/ban you from using amenities and common areas such as the community pool, club house and common areas.  This may seem unfair to a homeowner who is behind on their payments but somehow the HOA and condo associations need to be paid in order to properly maintain the property.

Due to the number of foreclosures, short sales and home owners who are delinquent on the fees have caused some Home Owners Associations, condo associations and cooperatives struggle to maintain the development and cover the cost of the perks home owners receive in their maintenance fees.   These developments will be deeply impacted if they do not receive the maintenance fees.
